Hi,
I am divorced and agreed to pay for my sons college tuition in a NYS suny school. I paid last year and asked my son to show me his grades he flat out refused. This year I told him and his mom that I wanted to be sure that he was attending school and had a passing GPA and wasnt just vegetating in his dorm room. His mother told me that he had stated that he had a 3.4GPA. I asked his mom if she actually saw his grades, she stated ,no I believe him. Well I did some investigagting on my own and found out that he had switched his major twice and was barely passing last year. This year I flat out refused to pay unless I knew he was actually studying, and not vegetating. Well I was just served by my ex to appear in family court, for non payment of his college tuition. Mind you I never had a problem paying, but I refuse to pay unless I know that he is making an effort in school. My question is, Do I have a leg to stand on when I ppear before the Judge?
                               Thanks All

I don't know the law in your state. In mine, the judge would listen to your concern and would likely be sympathetic.

Lee - would it not also depend on what his order actually states?

Sure. I didn't mean to imply otherwise.
