My x-husband and I were divorced in Nov of 2006 - we had separated in June of 2005.  We had a child support order based on the guidelines for our income.  We have modified the order once due to my oldest turning 19.  I have just found out that my husband falsely reported his income for years 2007 and 2008 and probably for 2005 and 2006 as well.  Can I now go back to court to get the amount I should have received?  He reported on his CS41's that he made roughly $35,000 a year and in bancruptcy documentation I have just seen he reports that his income for 2007 and 2008 was $58,096 - so we are talking about a considerable sum to me as I only make about $25,000 a year.

You can certainly try. However, you should also look at it realistically - if he's filing for bankruptcy, you're not likely to see the money anytime soon. Is it worth what you'll shell out (cause I don't see this as a DIY kind of project)?

I say go for it.  In most cases, child support is not bankruptable.

If you go to court, I would at least quit using that statement.  CS is not for YOU...CS is for the care of the child and believe me the courts will notice if you use the above apporach.
