I have a friend who has signed a quitclaim deed relinquishing his claim on the property she originally bought before their marriage, then added his name to when she rolled that loan into another one. Now she wants to refinance, but says he has to sign the new loan since it incorporates the old one. Supposedly the house is up for sale, so it seems stupid to refi now anyway . . . unless she's trying to use this to lure him back (one of the major fights was over the $2000 house payment)
Any thoughts?

The quit claim deed has NOTHING to do w/the mortage. Just b/c his name is not on the deed, it would still be on the mortgage (if it ever was)
Just signing the deed does NOT get it off of the mortgage. In my case, I got the house, he got the mortgage. He signed the quit claim deed so the house is JUST in my name. Both names remain on the mortgage b/c my attorney goofed and did not INSIST that he refinance and get it in his name only.
He is always treatening to quit work so that I will be responsible for the payments.

I think what your friend's wife means is that she WANTS him to be a party to the loan, probably because the lender has told her she will get better terms if he signs. Sounds like a bad idea to me. I would be inclined to tell her no thank you.

Thanks! Considering he works and she doesn't (well, she claims she doesn't, but that's under investigation!), I think I know why she wants him on the loan.
