We are divorced.

Our credit stinks so neither one of us can get our three joint loans separated at the bank.  (House, and we each took a car).

HE keeps paying on the loan he agreed to take late and now he's almost 3 months late.

This of course affects my credit score and my debt to income ratio, and I can't get another loan right now to pay for a second car I need.

My two joint loans that I took are paid on time.

What can I do to make our loan that he's got technically, but of course it's joint, to get it back in my hands?

The credit union won't work with us and unjoint our two car loans -- because my score stinks (thanks to him), and his score stinks worse.

I actually have the money saved up to get "HIS" loan paid up to date -- but that won't help my score, or untangle our joint loans.

I'm thinking to let the credit union repossess -- which they will do when he is 3 months behind -- and then work with them to get the car back and loan paid up to date.

In 7 days, he'll be 3 months behind.

Filing for contempt just doesn't seem like it will get me far -- $200 to file in this county, and then it won't be heard fast and by then who knows where the car will be.

Any other ideas?

Also thinking to have the car towed and locked behind a fence the day before the bank wants to and if he will give me the keys, then take possession and pay it from there on out.  Even though this goes against our final decree.  It isn't the only thing or part he hasn't lived up to, but I can deal with the rest so far.

If you want to make sure your credit isn't being hurt any further, you need to make sure the payments are being met (on time) for the loan.  Is it possible he would pay you directly? 

Only other thought would be to get a cosigner to get another loan to help you get it out of his name... but if you'll be paying the amount THEN, you might as well pay it NOW, even if it benefits him and goes against your decree.  It's a matter of what is your credit score really worth to you?

If you start paying the loan up... just let him keep making payments to it so that it comes off the principal and pays the loan off faster.  Paying it off would be a big help to your credit.

you can also write a statement to be included with your credit whenever companies run your credit with the 3 bureaus.  I think it's 150 words or less.

The question was actually for my daughter and her EX......

And her EX gave her the car back, so she went to the bank the next day and got the loan all caught up.

WHEW!

Now to tackle the bald tires, broken driver's window, putting insurance on the car and getting the bank to take theirs off, and a few other odds and ends
