My parents gave my inheritance to me early a little over 2 years ago so that my husband and I could use that money as a down payment on a nicer house closer into town.  We did.  We have lived in this house for 2 years and are most likely about to go through a divorce.  He has already spoken with an attorney who said that since this money was used for our downpayment, it is viewed as a gift to both of us and I will not be able to lay claim to as my own.  It is all I have.  Or will have.  So, any chance that this money is mine?  Or am I going to have to split it down the middle with him?

Thanks,
Amy

It's not as simple as you would like it to be, nor is it as simple as your husband describes it. In a divorce trial, a judge will hear your perspective and hear your husband's perspective and then decide what is fair. I wouldn't try to predict how a judge would weigh one case against another, and I would be leery of anyone else who says he or she knows.
