Child support Garnishment

My ex and i divorced about 9 months ago. I have custody of our 3 kids and she was ordered to pay $304 per month based on a minimum income salary. She was unemployed at the time. She has currently gotten a job but she owes all that back support and she is very slow in getting any money to me at all and when she does, it is never the amount she agreed to pay. I have heard that there is a way i can get the money taken from her check before she ever sees it. Does anyone know where I have to go to get that done? Our divorce was in Jefferson County which is where i currently live. She lives in Anniston.

From the info i read on your link. Looks like i need to go back to the Court where my case was decided and file the paperwork. If she quits work, which is likely, im guessing the next step would be to visit the folks at DHR. Thanks for the help.

Go to the courthouse where your divorce was granted and ask for an application for an Income Withholding Order. Fill it out with the total of her arrearage, and make sure you include the interest. They will serve it on Mom at work. If she objects, the court will set a hearing. If she doesn't the court will send the Income Withholding Order to her employer. In all likelihood, the chilld support is due to increase anyway, so you may be better off just contacting DHR now. Then they take care of everything.

I second Lee's opinion that you should contact DHR.  It is fantastic and cheap.  You pay a minimal fee (like $25 or something) and they will reveiw your case every 18 months and file for a modification if necessary, they do an IWO with your ex's employer and keep up with her when she job hops, you can go online and see payments, you can call the 800 number and hear payment info.  Now if only they'd get direct deposit....   Best of luck!
