Is mediation mandatory? When?
In a divorce or any motion hearing, Minnesota Statutes require that the parties discuss mediation. Although this falls short of making mediation mandatory, many courts will require the parties to meet with a mediator at a minimum.
Who pays for mediation?
In most cases the parties share the cost equally unless otherwise ordered by the Court.
What are the requirements for who can act as mediator?
A mediator must register with the State Bar Association and must demonstrate that they have completed the requisite Continuing Legal Education Courses to be certified as a Qualified Neutral.
